Project Terms and Conditions

These are current general project-term summaries. They become part of a project only when the versioned full-terms package is delivered with and explicitly accepted through that proposal. The exact accepted package controls over later website changes.

1. Project Scope

The signed proposal is the complete and exclusive statement of project scope. Any change requires a written change order signed by both parties before work proceeds.

2. Site Access and Preparation

Owner agrees to provide reasonable access to the kitchen during scheduled work hours. Owner is responsible for clearing personal items from cabinet interiors and countertops before the start date.

3. Conditions Discovered On-Site

If conditions discovered after work begins differ materially from those visible at the consultation (water damage, unsuitable substrate, hidden structural issues), ColorUp will pause work and provide a written change order before proceeding.

4. Schedule

The accepted proposal and current project schedule identify planned fabrication, in-home work, installation, and handoff timing. Dates may change only as allowed by the accepted terms, written project updates, approved changes, site readiness, supplier conditions, weather, or other documented circumstances.

5. Payment Terms

Deposit, payment schedule, accepted methods, processing fees, financing availability, and any amount currently due are shown in the accepted proposal, current invoice, or secure checkout presented for the project. Those records control over this public summary.

6. Workmanship Warranty

Unless the accepted proposal states a longer project-specific term, ColorUp provides a one-year limited workmanship warranty. An identified 2K coating upgrade carries a two-year workmanship term and three-year adhesion term for that coating scope. Warranty Covers

  • Chipping, peeling, or flaking under normal residential use.
  • Adhesion failure on properly-prepared substrates.
  • Process-related finish failure under normal residential use.

Warranty Does Not Cover

  • UV exposure and natural aging color shift over time.
  • Damage from impact (hammers, dropped objects, child play).
  • Damage from prolonged water exposure (flooding, leaks).
  • Damage from abrasive cleaners (e.g., Comet, steel wool).
  • Damage caused by third-party modifications, to the extent the modification caused or prevents diagnosis of the issue.
  • Substrate movement (warping, cracking) caused by extreme humidity changes.

Warranty Service

Report an issue through the secure project request link, the existing ColorUp conversation, or info@colorupcabinets.com with “Warranty Request” in the subject line. We review the project record and submitted evidence before deciding whether an inspection is needed. Eligibility and remedy are determined under the accepted warranty; approved covered work is handled as that warranty provides.

7. Cancellation

Texas law gives you a three (3) business day right to cancel a contract signed in your home without loss of deposit — see the rescission notice in your signed proposal. After that window, the deposit may be partially or fully non-refundable depending on what has been committed at the time of cancellation, including materials ordered, fabrication started, scheduling held, or third-party costs already incurred. Cancellation requests must be made in writing; ColorUp will provide a written accounting of committed costs within a reasonable timeframe. Rescheduling for weather, supplier delays, or other circumstances outside normal control on either side is handled without penalty.

8. Limitations Subject to Law

Any liability or damages limitation is governed by the accepted project agreement and applies only where Texas law permits it. It does not waive fraud, willful misconduct, personal injury where prohibited, the Texas Deceptive Trade Practices Act, or another nonwaivable right or remedy. If a limited remedy fails of its essential purpose, remedies available under applicable law remain available.

9. Indemnification

Each party indemnifies the other against losses caused by its own gross negligence or willful misconduct.

10. Governing Law

Texas law governs. Disputes resolved in Harris County, Texas.
